Terms of Use

Welcome to Fikra API. By accessing or using our application programming interfaces (APIs), software, infrastructure, and website (collectively, the "Services"), you agree to comply with and be bound by the following Terms of Use. These Terms govern your relationship with Fikra API, operated by Lacesse Ventures ("we," "our," or "us").

1. Acceptable Use Policy

Fikra API is business infrastructure. You agree not to use the Services to:

• Generate illegal, harmful, highly deceptive, or maliciously automated content, including phishing materials or malware.
• Attempt to bypass rate limits, circumvent billing mechanisms, or reverse engineer our API infrastructure or proprietary models (including Fikra Nano 1B).
• Infringe upon the intellectual property rights, privacy rights, or data protection rights of third parties.
• Deploy workloads that intentionally degrade the performance of our shared infrastructure tiers.

Lacesse Ventures reserves the right to immediately suspend or terminate access to any API key found violating these terms without refund or prior notice.

2. Tiered Infrastructure & SLAs

Fikra API operates across multiple commercial tiers, each governed by specific commitments:

• Self-Serve Tier: Provided "as-is" with a shared rate limit pool. No formal Uptime Service Level Agreement (SLA) is provided for this tier.
• Growth Tier: Commits to a 99.9% Uptime SLA and a reserved capacity of 500 Requests Per Minute (RPM). Support response time is guaranteed within 48 hours.
• Scale Tier: Commits to a 99.95% Uptime SLA and a reserved capacity of 2,000 RPM. Support response time is guaranteed within 24 hours, inclusive of direct Slack channel access.

Failure to meet the stated SLAs for Growth or Scale tiers will result in service credits applied to your account, calculated proportionally to the downtime experienced during that billing cycle. Refund guarantees (such as the $1K projection guarantee) apply strictly to executed, signed custom enterprise contracts outlining specific deliverables.

3. Billing and Payment Mechanics

Our commercial infrastructure utilizes a dual-stream billing model:

• Platform Fees: The fixed monthly cost for Growth ($50) or Scale ($138) tiers is billed upfront on the first day of your cycle. Failure to process this payment will result in an immediate downgrade to the Self-Serve tier, forfeiting reserved throughput and SLA guarantees.
• Usage Balance: Token consumption is metered and deducted from a prepaid wallet balance in real-time. If your balance reaches zero, inference requests will be rejected with a 402 Payment Required status until the balance is recharged via accepted rails (M-Pesa, Paystack, or Card).

4. Disclaimer of Liability Regarding AI Output

Fikra API routes requests to Large Language Models (LLMs) which generate output probabilistically. We make no warranties regarding the accuracy, reliability, safety, or factual correctness of the generated content. You are solely responsible for reviewing, filtering, and verifying the output before relying upon it or displaying it to end users. Lacesse Ventures shall not be held liable for any damages arising from hallucinations, inaccuracies, or offensive material generated by the models.

5. Data Privacy and Training

We do not use API data sent to Fikra API by Growth, Scale, or Custom Enterprise tier customers to train our foundation models. Data submitted via the API is transiently processed in memory for inference generation and logged temporarily strictly for abuse monitoring and billing purposes. 6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Lacesse Ventures, its founders, or affiliates be liable for any indirect, punitive, incidental, special, or consequential damages, including loss of profits, data, loss of goodwill, or business interruption, arising out of or in any way connected with the use of Fikra API. Our total cumulative liability for any claim shall not exceed the total amount you paid us in the three (3) months preceding the claim.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts located in Nairobi, Kenya.
