Welcome to Fikra API. By accessing or using our application programming interfaces (APIs), software, and website, you agree to comply with and be bound by the following Terms of Use.

1. Acceptable Use Policy

You agree not to use Fikra API to:

• Generate illegal, harmful, highly deceptive, or maliciously automated content.
• Attempt to bypass rate limits, circumvent billing mechanisms, or reverse engineer our API infrastructure.
• Infringe upon the intellectual property rights of third parties.

Lacesse Ventures reserves the right to immediately suspend or terminate access to any API key found violating these terms without refund.

2. Disclaimer of Liability Regarding AI Output

Fikra API routes requests to Large Language Models (LLMs) which generate output probabilistically. We make no warranties regarding the accuracy, reliability, or safety of the generated content. You are solely responsible for reviewing and verifying the output before relying upon it or displaying it to end users. Lacesse Ventures shall not be held liable for any damages arising from hallucinations, inaccuracies, or offensive material generated by the models.

3. Uptime, SLAs, and Refunds

While we strive for continuous availability, only users on our Enterprise Tier are covered by a financially backed 99.9% Uptime SLA. For standard tier users, the API is provided "as is". Our stated $1K refund guarantee applies strictly to executed, signed Enterprise contracts outlining specific deliverables and timelines.

4. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Lacesse Ventures, its founders, or affiliates be liable for any indirect, punitive, incidental, special, or consequential damages, including loss of profits, data, or business interruption, arising out of or in any way connected with the use of Fikra API. Our total liability for any claim shall not exceed the amount you paid us in the thirty (30) days preceding the claim.

5. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts located in Nairobi, Kenya.
